Obiettivi Formativi

Il corso di insegnamento di Legislazione delle Agenzie Investigative contribuisce a formare lo studente attraverso le conoscenze che riguardano la disciplina che l'ordinamento prevede per l'attività di investigazione privata e di costituzione di Agenzie Investigative. Infatti sono previste nel nostro ordinamento sia norme di natura autorizzativa della suddetta attività, sia norme relative al difficile rapporto tra investigazione e diritto alla riservatezza, sia norme che attribuiscono un ruolo importante e istituzionale nell'ambito dei processi penali all'investigatore privato di supporto con i difensori delle parti.

Learning Goals

The course of Investigative agencies Legislation helps to form the student through the knowledge concerning the discipline that the law provides for the business of private investigation and detective agencies. In fact are expected in our legal system's authorization of the said rules of nature activities, both rules relating to the difficult relationship between investigation and right to confidentiality, both institutional standards that attribute an important role in the context of criminal trials to support private investigator with the defenders of the parties.

Programma del Corso

Il corso studia i seguenti argomenti: origine e sviluppo delle Agenzie Investigative - la normativa attuale dalle norme contenute nel TULPS (Testo unico delle leggi di pubblica sicurezza), al Codice deontologico per avvocati e investigatori (D.M. n. 269/2010)e con riferimento alle norme contenute nel Codice della privacy (d.lgs. n. 196/2003)- l'ambito delle investigazioni private - i contenuti della professione e le principali tecniche investigative.

Course Syllabus

The course studies the following topics: origin and development of Investigative agencies-current legislation the norms contained in TULPS (consolidated laws of public security), the code of ethics for lawyers and investigators (D.M. n. 269/2010) and with reference to the rules contained in the code of privacy (d.lgs. 196/2003 #)-the scope of private investigations-the contents of the profession and the main investigative techniques.
