Obiettivi Formativi

Il corso ha come obiettivo quello di fare acquisire allo studente, secondo una prospettiva storica, conoscenze di base sullo sviluppo delle istituzioni italiane, nel contesto più ampio di talune esperienze europee Lo studente sarà in grado di: -comprendere l’evoluzione e lo sviluppo storico delle istituzioni italiane e europee -utilizzare le molteplici chiavi interpretative acquisite per comprendere la realtà del presente.

Learning Goals

The course provides a general knowledge of Western Constitutionalism and Political Institutions in the global scenario, through an historical and comparative approach. It analyzes the foundation and the development of western constitutionalism, as well as the structure and the transformations of constitutional law in western world, examining the foundation of constitutional law in western countries since the age of Revolutions and in the 19th century, underlining the different paths undertaken by western constitutional tradition. Thereafter by focusing on the contemporary age, it analyzes the political and legal features of constitutional democracies, taking into consideration several constitutional experiences in the of the contemporary state. Contemporary constitutionalism is also characterized by a process of internationalization: this process will be introduced in the next part of the course, where the stress will be on the development of an European constitutional space. Furthermore, the worldwide expansion of the pattern of western constitutionalism and the contemporary challenges of constitutional democracy in the age of globalization will be examined.

Verifiche dell'apprendimento

Oral examination on the topics dealt with in the course texts, on the dates indicated in the official calendar of exams. The examination will be aimed at ascertaining, in addition to skills and abilities related to both learning objective and course syllabus, also expository skills and correctness of language. It is possible to foresee ongoing intermediate tests, the modalities of which will be announced by the professor at the beginning of the course.

Assessment

Colloquio orale sugli argomenti trattati nei testi in programma, nelle date riportate sul calendario degli appelli degli esami. Il colloquio sarà volto ad accertare, oltre le abilità e competenze previste dagli obiettivi formativi e dai contenuti del corso, anche la capacità espositiva e la proprietà di linguaggio. È possibile prevedere prove intermedie in itinere le cui modalità saranno rese note dal docente all’inizio del corso.

Programma del Corso

With the support of specific power points, the following items will be focused:- -Constitutionalism and Institutions in the Age of the modern Revolutions. The different Paths of Western Constitutional Law in the 19th Century. The age of Democratization. Analyzing the pattern of Constitutional Democracy: the Anglo-American experience and the European experience. To the European constitutional space. The Charter of Fundamental Rights of the European Union. The worldwide expansion of Constitutional Democracy.

Course Syllabus

Il percorso che si vuole sviluppare durante le lezioni, avvalendosi dell’uso di specifici power points, intende prendere in esame le seguenti tematiche: Costituzionalismo e Istituzioni al tempo delle Rivoluzioni dell’età moderna. I modelli costituzionali del 19° secolo. L’età delle democrazie moderne: l’esperienza costituzionale nord americana ed europea. Verso uno spazio costituzionale europeo. La Carta dei diritti dell’Unione europea. L’espansione globale delle costituzioni democratiche.
