Lo studente sarà in grado, attraverso l’attività didattica, di comprendere il funzionamento dell’ordinamento costituzionale inglese e di quello degli Stati Uniti d’America e i relativi sistemi di Common Law.

Conoscenza del Diritto costituzionale italiano e del Diritto pubblico.

Verifiche dell'apprendimento

L’apprendimento viene verificato sia attraverso il costante dialogo fra docente e discenti nell’arco dell’intero corso di lezioni, sia attraverso l’esame finale, tendente ad accertare la corretta comprensione dei concetti tecnico-giuridici e la capacità di usare il metodo comparatistico nel confronto degli ordinamenti studiati.

Assessment

Learning is verified either through a constant dialogue between teacher and learners during the whole course of lectures, and through the final exam, aimed at assessing the correct understanding of the technical and legal concepts and the ability to use the comparative method in the comparison of legal systems studied.

Il Corso specialistico di Diritto pubblico comparato riguarda specificamente i due principali ordinamenti costituzionali di Common Law:Regno Unito e USA. Regno Unito: storia costituzionale, la costituzione non scritta, le leggi in materia costituzionale e le convenzioni costituzionali; la Corona; la Camera dei Comuni; la Camera dei Lord; il procedimento legislativo; il Premier , il Cabinet, il Governo, la forma di governo, lo scioglimento della Camera dei Comuni; il sistema elettorale; il sistema dei partiti; l’ordinamento giudiziario; Statute law e Common Law; overruling; le autonomie regionali; le recenti riforme costituzionali. Stati Uniti: storia costituzionale; la Costituzione rigida e la revisione costituzionale; l’elasticità della Costituzione; il Common Law e la Corte Suprema federale; la Corte Suprema potere costituente permanente? Course Syllabus

The advanced course of Public comparative law concerns the constitutional systems of the two major Common Law countries: UK and USA. UK: constitutional history, the unwritten constitution, constitutional laws and constitutional conventions, the Crown, the House of Commons, the House of Lords, the legislative process, the Premier, the Cabinet, the Government, in the form of government, the dissolution of the House of Commons, the electoral system, the party system, the judiciary, statute law and common law; overruling; regional autonomy; recent constitutional reforms. United States: constitutional history, the rigid Constitution and the constitutional revision, the elasticity of the Constitution, the Common Law and the Federal Supreme Court, the Supreme Court "permanent constituent power"? The President of the United States: Election, Appointment Power,Sword Power, Legislative Veto, Pocket Veto, the House of Representatives and the Senate, the electoral system of the Chambers, the legislative process, the Senate advise and consent on presidential appointments, the Senate and the Treaty-Making Power; impeachment; Federal State and the member States.
